1. Acceptance of Terms

Welcome to Tervapinyx. These Terms of Use ("Terms") govern your use of our yoga services, classes, and website. By accessing our services, registering for classes, or using our website, you agree to comply with and be bound by these Terms.

If you do not agree with any part of these terms, you may not use our services.

2. Description of Services

Tervapinyx provides yoga instruction and wellness services, including:

  • Prenatal yoga classes for expectant mothers
  • Children's yoga programs for ages 4-12
  • Senior yoga classes for mature practitioners
  • General yoga classes for all levels
  • Breathing technique instruction
  • Wellness consultations
  • Online resources and content

3. Eligibility and Registration

3.1 Age Requirements

  • Adults (18+): May register independently
  • Minors (under 18): Require parental/guardian consent and signature
  • Children (4-12): Must be accompanied by parent/guardian or have explicit permission

3.2 Health Requirements

You must:

  • Disclose any medical conditions, injuries, or physical limitations
  • Obtain medical clearance if pregnant or having health concerns
  • Inform instructors of any changes in your health status
  • Practice within your physical limitations

4. Class Policies

4.1 Booking and Attendance

  • Classes must be booked in advance
  • Arrive at least 10 minutes before class start time
  • Late arrivals may be denied entry for safety reasons
  • Class schedules are subject to change with reasonable notice

4.2 Cancellation Policy

  • Student cancellations: Must cancel at least 2 hours before class
  • Studio cancellations: You will be notified and offered alternatives
  • No-shows: Will result in forfeiture of class credit
  • Make-up classes: Available subject to availability and within membership period

4.3 Class Conduct

  • Mobile phones must be silenced and put away
  • Respect other students and maintain quiet during practice
  • Follow instructor guidance and modifications
  • Maintain personal hygiene standards
  • Wear appropriate yoga attire

5. Assumption of Risk and Liability Waiver

5.1 Assumption of Risk

You acknowledge that yoga practice involves physical activity and inherent risks, including but not limited to muscle strains, injuries, falls, and in rare cases, more serious injuries. You voluntarily assume all risks associated with participation.

5.2 Release of Liability

You release, waive, discharge, and covenant not to sue Tervapinyx, its owners, instructors, employees, and agents from any and all liability, claims, demands, or causes of action arising from your participation in yoga classes or use of facilities.

5.3 Medical Disclaimer

Yoga instruction is not a substitute for medical treatment. Consult your physician before beginning any exercise program. You are responsible for your own safety and wellbeing during practice.

6. Payment Terms and Membership

6.1 Payment Policies

  • Payment is due at time of registration unless otherwise arranged
  • Accepted payment methods include credit cards, debit cards, and cash
  • All sales are final unless otherwise specified
  • Prices are subject to change with reasonable notice

6.2 Membership Terms

  • Memberships are non-transferable
  • Membership benefits are valid only during the specified period
  • Unused classes or sessions do not roll over unless specified
  • Membership cancellation requires 30 days written notice

6.3 Refund Policy

  • Refunds are generally not provided except in exceptional circumstances
  • Medical emergencies may qualify for partial refunds with documentation
  • Class packages may be frozen for medical reasons with proper documentation
  • Refund requests must be made in writing

7. Facility Use and Property

7.1 Studio Rules

  • Remove shoes before entering practice areas
  • Personal belongings are stored at your own risk
  • Clean up after yourself and return props to designated areas
  • Report any damages or safety concerns immediately

7.2 Personal Property

  • Tervapinyx is not responsible for lost, stolen, or damaged personal items
  • Do not leave valuables unattended
  • Lost and found items will be held for 30 days

8. Special Provisions for Different Programs

8.1 Prenatal Yoga

  • Medical clearance from healthcare provider required
  • Must inform instructor of pregnancy stage and any complications
  • Modifications will be provided as appropriate
  • Stop immediately if experiencing discomfort

8.2 Children's Programs

  • Parent/guardian must complete waiver and medical forms
  • Children must be supervised as specified for each program
  • Behavioral expectations must be maintained
  • Parents are responsible for child's safety and conduct

8.3 Senior Classes

  • May require additional health disclosures
  • Modifications provided for physical limitations
  • Emergency contact information must be current

9. Intellectual Property

All content, including class sequences, written materials, audio recordings, and teaching methods, are proprietary to Tervapinyx and protected by copyright. You may not reproduce, distribute, or commercially use any studio content without written permission.

10. Privacy and Photography

  • Tervapinyx may take photographs or videos during classes for promotional purposes
  • Notify staff if you do not wish to be photographed
  • Students may not record classes without explicit permission
  • Personal information is handled according to our Privacy Policy

11. Code of Conduct

We maintain a respectful, inclusive environment. Prohibited behavior includes:

  • Discrimination, harassment, or inappropriate conduct
  • Disruptive behavior that interferes with classes
  • Use of inappropriate language or behavior
  • Violation of safety guidelines
  • Theft or damage to property

Violation of conduct policies may result in immediate termination of membership without refund.

12. Website Terms

12.1 Acceptable Use

  • Use website only for lawful purposes
  • Do not attempt to breach security measures
  • Do not upload malicious content
  • Respect intellectual property rights

12.2 User Accounts

  • You are responsible for maintaining account security
  • Provide accurate and current information

  • One account per person

13. Limitation of Liability

To the maximum extent permitted by law, Tervapinyx's liability is limited to the amount you paid for services. We are not liable for indirect, incidental, or consequential damages.

14. Indemnification

You agree to indemnify and hold harmless Tervapinyx from any claims, damages, or expenses arising from your use of services or violation of these Terms.

15. Force Majeure

Tervapinyx is not liable for failure to perform due to circumstances beyond our reasonable control, including natural disasters, government actions, or public health emergencies.

16. Modifications to Terms

We may update these Terms periodically. Changes will be posted on our website with the effective date. Continued use of services constitutes acceptance of updated Terms.

17. Severability

If any provision of these Terms is deemed invalid or unenforceable, the remaining provisions will continue in full force and effect.

18. Governing Law and Jurisdiction

These Terms are governed by the laws of New South Wales, Australia. Any disputes will be resolved in the courts of New South Wales.
